Motoring Offences - Costs Information

 

In accordance with the Solicitors Regulation Authority guidance on price transparency, we have published our typical prices and service information where it is possible to be upfront about charges without knowing the full details of the matter.

Please note that the above quotes do not include VAT however all the above charges will attract VAT @ 20%. 

 

A case which finishes on the day of the first appearance will involve a Solicitor or barrister attending Court to represent you. They will take you through the prosecution papers, take your instructions and advise you on your case. In Court, they will present mitigation on your behalf when being sentenced. 

 

If the case is adjourned for sentence, a Solicitor or barrister will also attend the 2nd hearing where they will advise you on the content of any probation report and will further advise you in relation to sentence. They will then represent you in Court, seeking to obtain the best result possible for you. 

 

Should you plead guilty but raise a special reason for the Court not to impose the minimal number of penalty points or disqualification, the case will likely be adjourned for a special reasons application. Prior to that hearing, in consultation with you, we will obtain all the requisite evidence to support your application. This may include witness statements, documentary evidence and anything else relevant to your case. A Solicitor or Barrister will then attend your special measure application hearing to present your case. 

 

Should you plead guilty and receive penalty points that would lead you to having 12 or more points on your licence, you would ordinarily receive a 6 month disqualification. If you wish to contest that on the basis that it would cause exceptional hardship, your advocate would apply for an adjournment to obtain witness statements and evidence to support your account. We would then arrange for an advocate to attend the exceptional hardship application hearing to present your case. 

 

Should you plead not guilty, we would offer a meeting with the Solicitor or paralegal responsible for your file whereby your full instructions can be taken. We would then seek to obtain statements from any relevant witnesses and any relevant evidence. We would deal with all correspondence with the Crown Prosecution Service and the Court. We would also advise you on the merits of serving a defence statement and whether your case could be assisted by way of instructing a relevant expert. If an expert is instructed, the cost would represent an additional disbursement for which you would be liable for. At your trial, an advocate will attend to present your case. 

 

The above costs would not cover any appeal or additional proceedings. 

 

Disbursements

 

Travel incurred by ourselves to and from police stations, Courts, site visits, prison visits and any other necessary journeys assosciated to your case is generally determined by network rail and TFL. Where a private vehicle is required, a charge of 45p per mile is chargeable. 

 

On occasion, an expert may be required to assist in your case however this will be determined by the nature of your case. The cost of such a disbursement would be pre-approved with yourself before being incurred.
